1. Introduction

Welcome to Futurabile (“Futurabile,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of futurabile.org (the “Site”), and your purchase of any products offered on the Site (collectively, the “Services”). By accessing the Site or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Information, and Refund & Returns Policy, which are incorporated by reference.

• All items are authenticated and described with measurements and condition notes.
• Orders are subject to availability, verification, and acceptance.

2. Definitions

“Account” means a registered user profile on the Site. “Products” means items listed for sale on the Site. “Business Day” means Monday–Friday, excluding U.S. federal holidays.

3. Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction to use the Services. By using the Services, you represent and warrant that you meet the eligibility requirements and are not prohibited from using the Services under applicable law.

4. Accounts & Security

To access certain features, you may create an Account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. Notify us immediately of any unauthorized use. We may suspend or terminate your Account for any violation of these Terms.

5. Authenticity & Condition

We specialize in authentic Supreme shirts and streetwear. Each item is reviewed against our internal archive and listed with clear photography and notes. Unless expressly stated, items may be pre-owned and can show minor wear consistent with age. Color tone can vary across screens; please review all photos and measurements before purchase.

Futurabile is not affiliated with, endorsed by, or sponsored by Supreme. “Supreme” and related marks are the property of their respective owners.

6. Pricing, Taxes & Currency

Prices are listed in U.S. Dollars (USD) unless stated otherwise. We reserve the right to change prices without notice prior to order acceptance. Applicable sales taxes and duties are calculated at checkout or upon import, depending on your location.

7. Orders, Acceptance & Cancellations

Your order is an offer to purchase. A contract is formed only when we send an order confirmation or ship the product. We may decline or cancel any order for reasons including product availability, suspected fraud, or pricing errors. If we cancel after charging you, we will refund the full amount paid.

To request a change or cancellation before shipment, contact us promptly at [email protected]. We cannot guarantee modifications after an order is placed.

8. Payments

We accept secure payments via major credit cards and PayPal, as displayed in our footer. By submitting payment information, you represent that you are authorized to use the chosen payment method and authorize us to charge the full order amount, including taxes, shipping, and any applicable duties.

9. Shipping & Delivery

We ship from New York, NY. Delivery estimates are provided at checkout and may vary by carrier and destination. Once an order ships, you will receive tracking details. Shipping terms, options, and cut-offs are described in our Shipping Information.

10. Risk of Loss & Title

Title and risk of loss pass to you upon our transfer of the Products to the carrier. Please inspect packages upon delivery and report any issues within 48 hours.

11. Returns & Refunds

We stand behind our descriptions. If an item materially differs from its listing, contact us for resolution. Returns must be authorized, unworn, and in original condition. For full details, see our Refund & Returns Policy.

12. International Customers

International orders may be subject to import duties, taxes, and fees, which are the recipient’s responsibility. You are responsible for compliance with local laws and for ensuring the Products can be lawfully imported.

13. Acceptable Use

You agree not to misuse the Services, including by: attempting to access non-public areas; interfering with the Site’s operation; using automated means to scrape content without permission; infringing intellectual property; or engaging in fraud, harassment, or illegal activity.

14. Intellectual Property

All content on the Site—including text, graphics, logos, photos, measurements, and page design—is owned by or licensed to Futurabile and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

Supreme is a trademark of its respective owner. Futurabile is an independent seller and is not affiliated with or endorsed by Supreme.

15. User Content

If you submit reviews, photos, messages, or other content (“User Content”), you grant Futurabile a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with the Services. You represent that you have the rights to submit the content and that it does not infringe third-party rights or violate any law.

16. Third‑Party Links

The Site may link to third‑party websites. We are not responsible for their content, policies, or practices. Accessing third‑party sites is at your own risk.

17. Disclaimer of Warranties

Except as expressly stated in writing, the Services and Products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non‑infringement. We do not warrant uninterrupted or error‑free operation.

18. Limitation of Liability

To the maximum extent permitted by law, in no event will Futurabile or its owners, employees, or agents be liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of profits, revenue, or data, arising from or related to your use of the Services or purchase of Products. Our total liability for any claim will not exceed the amount you paid for the Product(s) giving rise to the claim.

19. Indemnification

You agree to indemnify and hold harmless Futurabile and our affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Services, your violation of these Terms, or your infringement of any rights of another.

20. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

21. Dispute Resolution

Most concerns can be resolved by contacting us. If a dispute remains, you agree to resolve it through binding arbitration on an individual basis in New York County, New York, administered by a recognized arbitration provider, and you waive any right to a jury trial or to participate in a class action. Nothing in this section prevents either party from seeking injunctive or equitable relief for intellectual property infringement or misuse.

22. Changes to Terms

We may update these Terms from time to time. Changes are effective when posted to the Site. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

23. Miscellaneous

If any provision of these Terms is held invalid, the remaining provisions remain in full force. We may assign our rights and obligations under these Terms. These Terms, together with the incorporated policies, constitute the entire agreement between you and Futurabile regarding the Services.
